เรื่อง เรียกร้องปล่อยตัวแกนนำและสมาชิกกลุ่มคนอยากเลือกตั้งโดยไม่มีเงื่อนไข
ตามที่มี
“กลุ่มคนอยากเลือกตั้ง” ได้ใช้เสรีภาพในการชุมนุมและเดินขบวนโดยสงบปราศจากอาวุธเพื่อเรียกร้องให้มีการเลือกตั้งโดยเร็วเมื่อวันที่
22 พฤษภาคม 2561 ในโอกาสครบรอบ 4 ปี การยึดอำนาจของคณะรักษาความสงบแห่งชาติ (คสช.)
ที่มหาวิทยาลัยธรรมศาสตร์ ท่าพระจันทร์ และได้เดินขบวนไปยังบริเวณหน้าองค์การสหประชาชาติ
และเจ้าหน้าที่ตำรวจได้จับกุม ““กลุ่มคนอยากเลือกตั้ง”จำนวนสิบห้าคนในข้อหา5
ข้อหา คือประมวลกฎหมายอาญา มาตรา 116 หรือข้อหายุยงปลุกปั่น,
มาตรา 215 มั่วสุมกันตั้งแต่ 10 คนขึ้นไป ใช้กําลังประทุษร้าย ขู่เข็ญว่าจะใช้ กําลังประทุษร้าย หรือกระทําการอย่างหนึ่งอย่างใดให้เกิดการวุ่นวายขึ้นในบ้านเมือง,
มาตรา 216 ไม่เลิกมั่วสุม
เมื่อเจ้าพนักงานสั่งผู้ที่มั่วสุมเพื่อกระทําความผิดตามมาตรา 215 ให้เลิกไป, ข้อหาฝ่าฝืนคำสั่งหัวหน้า คสช. ที่ 3/2558
ข้อ 12 ห้ามชุมนุมทางการเมืองตั้งแต่ 5
คนขึ้นไป, และฝ่าฝืน พ.ร.บ.การจราจรทางบก
มาตรา 108 ห้ามเดินแถวในลักษณะกีดขวางการจราจร นั้น
สมาคมสิทธิเสรีภาพของประชาชน(สสส.)
เห็นว่าการชุมนุมของ “กลุ่มคนอยากเลือกตั้ง”
เป็นสิทธิเสรีภาพในการแสดงความคิดเห็นและการชุมนุมโดยสงบและปราศจากอาวุธ
ซึ่งชอบด้วยรัฐธรรมนูญ และกฎหมายระหว่างประเทศและกติการะหว่างประเทศว่าด้วยสิทธิทางการเมืองและพลเมือง
อีกทั้งการเรียกร้องให้มีการเลือกตั้งถือเป็นสิทธิขั้นพื้นฐานในระบอบประชาธิปไตย
ประกอบกับรัฐบาลประกาศให้สิทธิมนุษยชนเป็นวาระแห่งชาติ
ก็ต้องมีความจริงใจที่จะรับฟังเสียงของทุกฝ่ายและสร้างบรรยากาศทางการเมืองที่เป็นประชาธิปไตยอย่างแท้จริง
ดังนั้น การที่เจ้าหน้าที่ตั้งข้อหาต่าง ๆ ต่อบุคคลดังกล่าว
รวมทั้งข้อหาความผิดฐานฝ่าฝืนคำสั่งของ คสช.ที่ 3/2558
อันเป็นคำสั่งที่ไม่ชอบธรรมเนื่องจากเป็นคำสั่งของกลุ่มบุคคลที่ใช้กำลังก่อการรัฐประหารยึดอำนาจรัฐ
จึงเป็นการกระทำที่ขัดต่อหลักของความยุติธรรมและพันธกรณีระหว่างประเทศที่ประเทศไทยมีอยู่
และอาจถูกมองได้ว่า เป็นการใช้กฎหมายเพื่อกลั่นแกล้ง ปิดปาก ผู้ที่มีความเห็นทางการเมืองแตกต่างจากรัฐบาล
จึงขอเรียกร้องต่อหัวหน้าคณะรักษาความสงบแห่งชาติ
และสำนักงานตำรวจแห่งชาติ ดังนี้
1. ขอให้ปล่อยตัวแกนนำกลุ่มคนอยากเลือกตั้งทั้ง 15 คน โดยเร็วอย่างไม่มีเงื่อนไข
2.
ขอให้ยกเลิกคำสั่งคณะรักษาความสงบแห่งชาติที่ 3/2558 และคำสั่งหรือประกาศอื่น
ๆ ของ คสช. ที่ลิดรอนสิทธิเสรีภาพของประชาชน
3.
ยุติการปิดกั้นการแสดงออกทางการเมืองและการชุมนุมสาธารณะ
4.
รักษาคำมั่นสัญญาที่ให้ไว้แก่ประชาชนและนานาประเทศว่าจะมีการเลือกตั้งโดยเร็ว
ด้วยความเชื่อมั่นในหลักการประชาธิปไตยและการเคารพหลักการสิทธิมนุษชน

Release leaders
and members of We Want Elections unconditionally
On 22 May 2018, “We Want Elections” has exercised their right to freedom of peaceful and unarmed
assembly and demonstration to demand elections to be held soon. It was also
organized to mark the fourth anniversary of the seizure of ruling power by the
National Council for Peace and Order (NCPO). The demonstration started off from
Thammasat University’s Tha Phrachan Campus. Upon their arrival at the area in
front of the UNESCAP building, 15 of them were arrested by the police for
violating Section 116 of the Penal Code or sedition, Section 2015 for ten
persons upwards being assembled together do or threaten to do an act of
violence, or do anything to cause a breach of the peace, Section 216
for refusing to be assembled when ordered so by competent official for
the persons assembled to stop committing an offence per Section 215,
for violating the Head of the NCPO Order no. 3/2558’s Article 12 prohibiting a
political gathering of five persons and upward and for violating Section 18 of
the Road Traffic Act prohibiting walking in line that may obstruct road
traffic.
Union for Civil Liberty (UCL) has found the demonstrations
of “We Want Elections” an exercise of
the right to freedom of expression and peaceful and unarmed assembly. Such
right is prescribed for in Thailand’s Constitution and International Covenant
on Civil and Political Rights (ICCPR). Also, a demand to have elections is a
fundamental right in a democracy. The government has also declared human rights
a national agenda. Therefore, it must show its sincerity to listen to voices of
all parties and to nurture genuinely democratic political system. Therefore, by
pressing charges against these individuals including the violation of the Head
of the NCPO Order no. 3/2558 which is an unlawful order since it has been
decreed by a group of people who have staged a coop to seize ruling power, it
is tantamount to a breach of justice and international obligations which
Thailand has to abide by. This could be viewed as an attempt to use legal
action to abuse and silence political dissents.
We have the following demands to make to the Head of the
NCPO and the Royal Thai Police;
1. Release15 leaders and members of We Want Elections promptly and
unconditionally.
2. Revoke
the Head of the NCPO Order no. 3/2558 and other Orders and Announcements issued
by the NCPO to restrict people’s rights and freedoms.
3. Stop
stifling political expression and restricting public assembly.
4. Honor a promise made to Thai people
and international community to hold elections as soon as possible.
